MyTwoCensus Scoop: Census Bureau regional partnership coordinator running as a Democrat for New York State Assemblyman while still on the job

UPDATE: At 10:00, a credible e-mail came in to the MyTwoCensus inbox stating that Mr. Dominguez was upset at his office. At 10:50, I spoke with Steve Jost, Associate Director of the Census Bureau, who informed me that Mr. Dominguez is no longer employed by the Census Bureau. Presumably, he was fired as a result of this scoop.

Rafael Dominguez, a New York-based regional partnership coordinator for the US Census Bureau since early 2008 has filed a petition to run as a Democrat for Assemblyman for New York’s 82nd District. Yet, as Census Bureau Associate Director Steve Jost recently commented on a MyTwoCensus.com post, the Hatch Act, “prohibits federal employees from engaging in partisan political activities while on duty.”

The problem is not that Mr. Dominguez is running for office, the problem is that he is running for office while an employee of the federal government and campaigning on the Census Bureau/taxpayer’s dime. MyTwoCensus.com has also learned that other Census Bureau employees who are underlings of Mr. Dominguez have been performing campaign activities while on official Census Bureau duty. These employees include other partnership assistants in the New York area:  Ed LaFranco and Adrian Tapia.

New Yorkers should be entitled to a partisan-free census, and Mr. Dominguez’s overt Democratic Party affiliations require the Census Bureau to fire him immediately. MyTwoCensus has subsequently learned that Mr. Dominguez used his (massive) budget for partnership materials to fund events and organizations that will benefit his political campaign.

Admittedly, it will be difficult to prove that partnership  funding was diverted for specific purposes that relate to the campaign, but such activities should immediately be scrutinized and audited more thoroughly than they already are. (MyTwoCensus.com has learned that the New York Census Bureau’s partnership office is currently undergoing a major audit. Perhaps this audit is directly tied to Dominguez and his misuse of funds, but more likely it has to do with rampant excesses by the Census Bureau’s partnership specialists.)

    If these allegations are true and in violation of the terms of employment with the Census, Mr. Dominguez should be punished with the full extent of the law.
    However, being a Democrat under the current Administration, I would not expect any fines or penalties. This story will fade.

    Mr. Dominguez is not currently working for the Census. All our employees are routinely briefed on the provisions of the Hatch Act and Title 13. Federal employees may support candidates for office on their own time, but may not use government resources in any way to assist a candidate.

    I don’t think he’s been fired, typically as it’s been in the past the Regional Director or Deputy Regional director would send an e-mail out that he’s been fired. Also we would get an e-mail about the door lock being changed for security. Neither of those two e-mails came accross.

    Redbone…I completely agree with you. The NYRCC is full of cronies and phonies. The DRD, ACRM and some AM must be investigated. Partnership has a long list of crooked “no show” opportunities. They not only mismanaged the budget on give-aways, but they also mismanaged the budget on staffing and media attention……somewhere in the MANUAL, it states no employee of the Census should be paid while on the job to be interviewed by the media…..There are so many people that have broken the law (condone by MEdia and Partnership from the RD down) even as it pertains to the Hatch, PII, IT and EEO and they are still employed. Area Managers that have ridiculed and threaten staff at all levels.

    C’mon, all the crooks need to be investigated!

    From an ex-Census employee from the Brooklyn area who saw so much crap and incompetence from all levels of management, does ANY of this really surprise you? I can only imagine the nonsense that is still to be uncovered in the days , weeks and months ahead as this absurdity continues….As stated by “tellitlikeitis”..The NY RCC was the epicenter of croneyism, incompetence and mismanagement rhen I’m sure in anywhere in the country… Area Managers, paid 6 figure salaries for god knows what, parade as “mentors” and “problem solvers”, when in reality they flamed the EEO fires that ran rampant in Brooklyn. Pathetic RT’s that had their own agendas and caused resentment and EEO issues themselves were allowed to run wild…Sexual innuendo, profanity, harrassment were just some of the issues that became commonplace in a work environment that Area Managers turned blind eyes to… Hired LCOMS that were either woefully inept or totally unskilled were part of the norm in Brooklyn…so does it surprise ANYONE that Partnership people would use the Census platform for their own personal gain?? The amount of money WASTED on partnership expenses, with unattended photo-op events and useless meetings with community leaders that did nothing to assist in the LCO operations…

    Special note to the ARCM, who by her lack of leadership and foresight lead to this fiasco in “Aviles-land”…ask yourself this question ARCM…you painted Aviles as the “face of the census…the media darling”…feel like a fool yet ???

    Wow, talk about your conspiracy theorists! Do you think it’s even remotely possible that what you have here is an overzealous guy who simply forgot his training? I’ve seen a lot of cr*p on this site, but this ranks right up there. Shame on you Morse for impugning someone who more than likely just made a really amateur blunder in what looks like his inaugural political campaign. What you fail to appreciate in all your rantings is that the census has — by necessity — a massive crew of short-timers who do an amazing job all things considered. Geez, if census workers made as many errors as you do, it truly WOULD be in serious trouble.

    Forgot their training? Would that be a valid excuse if they forgot their training on confidentiality. The fact is, this employee like all others signed a forms stating that they fully understand things like ethics, title 13 and the hatch act. If they did not understand these things then they should have said something the opus is on the employee not the agency to know the rules.

    So unless you are willing to allow a simple lapse of training account for shareing your personal data you shouldn’t apply that to the hatch act.

They are totally responsible for this fiasco. These two individuals are among the most incompetent managers in the Census Bureau. Everyone knows that they gave Mr. Dominguez and his cronies’ the liberty to as they pleased with absolutely no oversight! They as well as Washington were alerted to all that has been going on in this office since the start of the decennial census and they chose to turn a blind eye! It is a well known fact that NYRCC management encourages and supports unethical and illegal practices. Unfortunately, this is just the tip of the iceberg. I’m sure there is more we don’t know about that is going on here…..

If your accusations have any merit, why haven’t you presented sufficient evidence, and blew the whistle on the entire department prior to this incident.     Yes Mr. D and his henchmen? If you worked out of the RCC you would know that Mr. D had many people brown nosing him including but not limited to the ones mentioned by NYRCC. These employees were starved for attention and would do anything to get noticed. They knew they could get noticed by keeping Mr. D happy. Unfortunately he was given way too much power and he made sure everyone at the RCC knew that. He went to extremes; using the Census for his own benefit. Everyone but him knew this. He seemed oblivious; since he was so consumed by the power given him Power and greed are crazy things. His henchmen didn’t help this situation, they cooperated; they knew. They used the circumstances to their advantage. They sold their souls to get ahead. If he/they didn’t know what he/they was doing was wrong ,why didn’t he/they announce it or let anyone know about his campaign.     TOP 10 THINGS I LEARNED AT THE CENSUS:
    1. The Census is poorly managed!
    2. Government employees paid to work for the census worked on a personal campaign gathering signatures during business hours and everyone knew it
    3. Tell it like it is, tells it like it REALLY is!
    4. There were more PA’s in the Bronx than Manhattan and Brooklyn combined, now we know why!
    5. You learn more about the census at mytwocensus than in any Census manual
    6. Management encourages its coordinators to give minimal information to OIG
    7. You don’t have to make a cert to get a management job in NY and speaking spanish is a plus
    8. Watchdog 34 hit the nail on the head
    9. If you’re not sure of the rules of employment, ask your buddy, especially if its the DRD and don’t put it on facebook until you’re sure!
